Official Rules

1. NO PURCHASE NECESSARY. To Enter:
Via social media: Create a “wallpaper” using a San Francisco 49ers-themed template on Adobe’s Express product, and upload it to Instagram (in feed) or Twitter with the program hashtag: #adobe49ersfaithful, any time between 12:00:01 a.m. PT on October 26, 2022 and 11:59:59 p.m. PT on November 2, 2022 (“Promotion Period”). Participants entering via social media are required to have an Instagram account, available for free sign up at instagram.com or Twitter account, available for free sign up at twitter.com; Adobe free trial available at adobe.com. If entering via social media, entrant’s Instagram or Twitter account must be set to “public” in order for the entry to be eligible; account may be returned to “private” any time after winner has been determined. Via postcard: Alternatively, you may enter by mail by sending a standard-size postcard, only, with your full name, address, phone number, email address, and program hashtag: #hashtagTBD to: Adobe Wallpaper Wednesday San Francisco 49ers Sweepstakes, PO Box 612, Marblehead, MA 01945. Limit one (1) entry per person, regardless of entry method. Entries must include promotion tag to be eligible. Providing multiple entries or otherwise failing to abide by these Official Rules will result in Sweepstakes disqualification. Social media posts must comply with all terms and community guidelines associated with the applicable social media platform and may not include any content that may be deemed obscene, violent, or offensive, or that may infringe on the privacy of any person other than an entrant, or communicate messages or images inconsistent with the positive image and good will of the Adobe or San Francisco 49ers brand. Any entries that contain, depict, or show such content as defined above and/or that violate these requirements and/or the terms of these Official Rules will be disqualified. The Sponsor reserves the right in its sole discretion to disqualify any entry that they believe is inappropriate or not suitable for publication, that does not comply with these Official Rules, or that is not consistent with the spirit or theme of the Sweepstakes. Sponsor and its promotion partners reserve the right to publish any submitted entries, in full or in part, in any and all media. Publication of an entry is not intended to indicate that the entry has been selected as a prize winner or is favored in any way. In the event of a dispute regarding the identity of any entrant, the entry will be deemed made by the person identified as the authorized account holder of the email address associated with the social media account at the time of entry (i.e., the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address). Online entries must be received 11:59:59 p.m. PT on November 2, 2022. Mail-in entries must be postmarked by November 2, 2022 and received by November 8, 2022.

2. Drawing:
Winner will be selected via random drawing from among all eligible entries received by the deadline of the Promotion Period. Drawing will be conducted on or around November 9, 2022 by PROMOSIS, INC. (“Administrator”), an independent judging organization whose decisions in all matters relating to this Sweepstakes are final. Potential winner will be notified via social media direct message from Adobe’s Instagram or Twitter account (or via email if entering by postcard), and will be required to complete an online winner verification within three (3) days of the date of the winner notification, or prize will be forfeited. Any potential winner who fails to respond to the winner notifications or is found to be ineligible will be disqualified, and an alternate winner will be randomly selected from the remaining pool of entries received for the original drawing.

3. Prize:
One (1) Grand Prize: Two (2) tickets to a San Francisco 49ers 2022 NFL home game at Levi’s Stadium in Santa Clara, plus a 49ers merchandise pack (hoodie, t-shirt, hat). Approximate retail value of Grand Prize = $575. Actual value may vary based on game date, seat location, and assessment of prize elements publicly available. Any difference between actual value and stated maximum value will not be awarded in cash or other consideration. Game tickets will be chosen by sponsor. Prize may not be transferred or redeemed for cash, in whole or in part. Winner is solely responsible for all applicable federal, state, or local taxes on the value of the prize. Grand Prize consists of game tickets and merchandise pack, only; any other expenses associated with the Grand Prize are at the winner’s discretion, and are not included. Sponsor will not be responsible for replacement of any lost or stolen tickets once they are in winner's possession or in the possession of the winner’s guest. Game tickets are subject to the terms and conditions specified by the NFL. Winner and guest must comply with all venue regulations, and agree to all Levi’s Stadium policies, or prize may be forfeited. No substitution for prize, except by Sponsor as may be due to unavailability. If originally-offered prize is unavailable at the time of award, Sponsor may substitute an item of comparable or additional value. By accepting a prize, winner agrees to grant to the Sponsor and its promotion partners the right without limitation to use the winner’s name, picture, portrait or likeness, and voice in any future promotional material connected with this sweepstakes in any and all media, now known or hereafter devised, without further compensation, where permitted, and that such use can be made without prior inspection or approval of the use of any copy used in connection with it. No more than the stated number of prizes will be awarded. Odds of winning a prize are dependent upon the total number of entries received by the entry deadline.

4. Eligibility:
The sweepstakes is open to legal residents of California who do not live within seventy-five (75) miles of Sacramento, CA (unless residing closer to San Francisco, CA than Sacramento, CA) or within seventy-five (75) miles of Los Angeles, CA, who are 18 years of age or older at the time of entry. Not open to employees and their families (spouses, parents, children/siblings and their respective spouses, and those living in the same household) of Adobe Inc., CAA Brand Consulting, Forty Niners Football Company LLC, Forty Niners Stadium Management Company LLC, Forty Niners SC Stadium Company LLC, the NFL Entities (defined as the National Football League ("NFL"), its member professional football clubs, NFL Ventures, Inc., NFL Ventures, L.P., NFL Properties LLC, NFL Enterprises LLC, NFL Productions LLC, NFL International LLC and each of their respective subsidiaries, affiliates, shareholders, officers, directors, agents, representatives and employees), and their respective parent companies, subsidiaries, affiliates, promotion partners, their advertising and production agencies, and PROMOSIS, INC. Entrants consent to the use of their registration information in accordance with the Adobe privacy policy. Entrants agree to the release of their name, address, and email information to Promosis for winner notification purposes and for public winner disclosure, as required by law. Sweepstakes is void where prohibited by law or regulation, and is subject to all applicable Federal, State, and local laws and regulations. By entering, participants agree to be bound by these Official Rules.

5. Limitation of Liability:
Sponsor and its promotion partners, independent judging organization, and their affiliates are not responsible for typographical errors in any sweepstakes-related materials; for lost, late, misdirected, or incomplete entries or email; for technical, hardware, software, Internet, or telephone failures of any kind; for lost or unavailable network connections; for viruses; or for failed, incomplete, garbled, or delayed computer transmissions that may limit or interfere with a participant’s ability to take part in the promotion. Entries generated by script, macro, or other automated entry devices are not valid and will be disqualified. Sponsor reserves the right to disqualify and seek prosecution of any entrant who disrupts or interferes with the proper play of the sweepstakes, or acts in violation of these Official Rules in any way. Sponsor reserves the right to cancel or modify promotion if fraud or technical failure compromises the integrity of the promotion, or corrupts or impairs the administration, security, fairness, or proper play of the sweepstakes, as determined by Sponsor in its sole discretion. If sweepstakes is canceled for any reason, including but not limited to those stated above, winner will be determined via random drawing from among all eligible entries received up to the time of cancellation. Sponsor and its promotion partners, employees, agents, officers, directors, members, managers, and owners of the San Francisco 49ers, the NFL Entities, and each of their respective parents, subsidiaries, affiliates, owners, members, directors, managers, officers, employees shall not be liable for injury, losses, damages, or costs of any kind resulting from participation in this promotion, or acceptance of or use or misuse of a prize or parts thereof. The NFL Entities will have no liability or responsibility for any claim arising in connection with participation in this promotion or any prize awarded. The NFL Entities have not offered or sponsored this promotion in any way. This promotion is in no way sponsored, endorsed, or administered by, or associated with Instagram or Twitter, nor are they responsible for prize awards. ENTRANT WAIVES CALIFORNIA CIVIL CODE SECTION 1542, WHICH STATES: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY” (OR ANY EQUIVALENT STATUTORY PROVISION WITH A SIMILAR IMPORT OR INTENT).

6. Dispute Resolution:
THIS SWEEPSTAKES IS GOVERNED BY THE LAWS OF THE UNITED STATES AND THE STATE OF CALIFORNIA, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this sweepstakes, participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively before a court located in California having jurisdiction. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys' fees, other than participants' actual out-of-pocket expenses (i.e. costs associated with entering this sweepstakes), and participant further waives all rights to have damages multiplied or increased.
